En atención a la noticia publicada en su edición de 9 de diciembre de 2016, en la que se hace referencia a la situación jurídico-política  del expresidente Ricardo Martinelli en Panamá, tengo a bien indicarle lo siguiente:

1.  Es equivocado afirmar que el ex presidente Martinelli está en Estados Unidos para evitar enfrentar estos procesos políticos. La realidad es que el ha enfrentado cada uno de ellos a través de sus abogados, como lo permiten nuestras leyes y nuestra constitución, al no ser este parte formal de los procesos, por no tener condición de imputado ni de acusado; la realidad es que el se encuentra en Estados Unidos, porque su vida corre peligro por la persecución política del presidente  Juan Carlos Varela.

2.   Ninguna de las investigaciones que se han iniciado al ex presidente Martinelli, son producto de denuncia o querella alguna. Las mismas son provocadas por la remisión de expedientes por parte del Ministerio Público que controla el presidente Juan Carlos Varela.

3. Al expresidente Ricardo Martinelli no se le ha formulado cargos por ningún delito en la República de Panamá por la Corte Suprema de Justicia.

4. Todas las investigaciones  iniciadas son procesos políticamente motivados, que forman parte de la persecución política del Presidente Juan Carlos Varela, valiéndose del control y las presiones que ejerce sobre el Ministerio Publico y la Corte Suprema de Justicia. Esta venganza absurda de Varela, se produce porque el ex Presidente Martinelli, lo destituyó del cargo de Canciller de la República, cargo que este ocupó en la gestión del ex presidente.

5. La supuesta vinculación en el caso conocido como comida deshidrata surge de la mención hecha por el exdirector del PAN, declaración que surgió de presiones indebidas e ilegales para involucrar falsamente al expresidente Martinelli, tal como denunció luego de la diligencia el propio abogado del exdirector del PAN. Es importante destacar que en los auditos realizados por la Contraloría General del Republica, organismo fiscalizador de los fondos públicos, no se menciona en ninguna de sus partes al expresidente.

6.  De las investigaciones relacionadas con las supuestas escuchas telefónicas es necesario destacar que no existe ninguna prueba documental o material que vincule al expresidente Ricardo Martinelli en los supuestos hechos, al igual que en el caso antes mencionado, la supuesta vinculación proviene de un supuesto testigo protegido.  Se destaca, que en la causa del tribunal en el que se inició la investigación, el juez determinó lo siguiente: a) No existe testigo protegido; b) La dirección y número de teléfono aportados por el supuesto testigo protegido son falsos.

Es importante destacar, que existen numerosos testimonios de personas que fueron objeto de presiones y torturas psicológicas para involucrar falsamente al ex presidente Ricardo Martinelli en los supuestos hechos.

Absurdamente, pese a no existir imputación ni acusación contra el ex presidente Martinelli, que lo convierta en parte del expediente, se procedió a adoptar medidas ilegales de: declaratoria de rebeldía; orden de detención con fines de extradición y se presentó una solicitud de extradición.

7. A la fecha, a la Corte Suprema de Justicia han sido remitidas 21 solicitudes de investigación en la que se pretende involucrar falsamente al ex presidente Ricardo Martinelli, de las cuales solo se han admitido 7, están pendientes de decisión 9 y han sido rechazadas 5; reitero que ninguna de estas investigaciones han generado imputaciones de cargos ni acusaciones.

Es un hecho conocido, que el expresidente Ricardo Martinelli y otros funcionarios de su administración son perseguidos políticos del actual presidente Juan Carlos Varela, cuya gestión refleja en todas las encuestas de opinión pública, bajísimos índices de aprobación.  Es ya costumbre que ante caída suya en las encuestas y ante el surgimiento de actos de corrupción de la administración Varela; se presenten nuevos casos contra el ex presidente o contra funcionarios de su administración.

In light of the news published in its edition of December 9, 2016, which refers to the legal and political situation of former President Ricardo Martinelli in Panama, I have to indicate the following:

1.      It is wrong to say that former President Martinelli is in the United States to avoid facing these political processes. Actually having no accused status and haven't not being formally charged, he has faced each of this processes through his attorneys as granted by our laws and constitution. Is a fact that he remains in the United States because in Panama his life is threatened by the political persecution of President Juan Carlos Varela.

2.      None of the investigations initiated against former President Martinelli are on response of a complaint. Those are caused by the Public Ministry remission of files, under President Juan Carlos Varela's control. 

3.      Former President Ricardo Martinelli has not been charged with any crime in the Republic of Panama by the Supreme Court of Justice.

4.      All the investigations initiated are politically motivated processes, which are part of the political persecution of President Juan Carlos Varela against Former President Martinelli, using the control and pressure he exert on the Public Ministry and the Supreme Court of Justice.

5.      The alleged linkage in the case known as "dehydrated food" arises from the mention made by the former PAN director, a statement that arose from undue and illegal pressures to falsely implicate the Former President Martinelli, as denounced after the diligence done by lawyer of the former director Of the PAN. It is important to note that in the audits carried out by the General Controller of the Republic, a body that supervises public funds, the Former President is not mentioned in any of its parts.

6.      Of the investigations related to the supposed alleged wiretaps, it is necessary to highlight that there is no documentary evidence or material that links former President Ricardo Martinelli in the alleged facts, as in the case mentioned above, the alleged linkage comes from an alleged protected witness . It is noted that in the case of the court in which the investigation was initiated, the judge determined the following:

a) There is no protected witness; 

B) The address and telephone number provided by the alleged protected witness are false.

It is important to note that there are numerous testimonies of people who were subjected to psychological pressure and torture to falsely implicate former President Ricardo Martinelli in the alleged facts.

Absurdly, although there was no imputation or accusation against former President Martinelli, which made him part of the file, illegal measures were taken to: declare a rebellion; Arrest warrant for extradition purposes and an extradition request was submitted.

7.      To date, 21 requests for investigation have been submitted to the Supreme Court of Justice trying to falsely involve former President Ricardo Martinelli, of which only 7 have been admitted, 9 are pending of decision  and 5 have been rejected; I reiterate that none of these investigations have led to imputations of charges or accusations.

It is a known fact that former President Ricardo Martinelli and other officials of his administration are persecuted politicians of the current President Juan Carlos Varela, whose management reflects, in all public opinion poll, very low approval ratings. It is being a fact that every time Varela's acceptance falls in the polls and / or acts of corruption of the Varela administration are revealed, new cases are brought by President Varela against the former president Martinelli or against officials of his administration as an strategy of distraction.
